2. The Community
The myCAhub Clubhouse is a professional WhatsApp community intended to facilitate discussion, learning, networking, support and the sharing of practical information among Chartered Accountants, finance professionals, students and other approved participants.

Membership of the Community is personal, limited and revocable.
Access to the Community is a privilege and not an automatic or permanent right.
Admission, continued membership and access to individual groups or subgroups are subject to myCAhub’s discretion and applicable law.
myCAhub may refuse admission, restrict participation, mute a member, remove a member, block a telephone number or deny future access where myCAhub considers this necessary to protect:
- Members;
- Administrators, moderators or contributors;
- The purpose, culture or operation of the Community;
- myCAhub’s intellectual property;
- Confidential or Personal Information;
- The security of the Community; or
- myCAhub’s legal, commercial or reputational interests.
myCAhub is not required to provide advance notice, a warning, reasons or an appeal process before removing or restricting a member.
Members may not transfer their Community access, allow another person to participate through their WhatsApp account or rejoin through another telephone number after being removed without myCAhub’s prior written permission.
4. Community Rules
Members must behave lawfully, professionally and respectfully.
You may not use the Community to:

- Use Community content to train, populate or develop an external database, artificial intelligence tool, publication, course or competing service; or
- Use the Community in any manner that creates legal, regulatory, security, operational or reputational risk for myCAhub or its members.
myCAhub may publish additional rules for specific groups or subgroups. Any such rules form part of these Terms.
5. No Professional Advice
The Community is provided for general information, discussion, support and educational purposes only.

- Tax advice;
- Legal advice;

- Employment or recruitment advice;
- Career advice;
- Regulatory advice;
- Medical or mental-health advice; or
- Professional advice of any kind.
The fact that a member, administrator, contributor or community lead holds a professional designation does not create a professional-client, adviser-client, accountant-client, attorney-client, fiduciary or other professional relationship.
Community content may be incomplete, inaccurate, outdated, simplified, misunderstood or based on an individual’s personal opinion or circumstances.
You remain responsible for:
- Verifying information against current and official sources;
- Considering your own facts and circumstances;
- Obtaining advice from an appropriately qualified professional; and
- Making your own professional, financial, career, employment and business decisions.
You rely on Community content entirely at your own risk.

By submitting Member Content, you confirm that:
- You have the right and authority to submit it;
- It does not unlawfully infringe another person’s rights;
- It does not contain information that you are prohibited from disclosing;
- It is accurate to the best of your knowledge where it is presented as factual; and
- Its use in accordance with these Terms will not breach any duty owed to another person.
You remain responsible for the Member Content you submit.
myCAhub is not required to review, verify, approve, publish, retain or preserve Member Content and may edit, hide, remove or decline to use Member Content at any time.

myCAhub may use individual questions, recurring themes, discussion insights and answers to develop its own independently researched, verified, edited, expanded or reformatted content.
No payment, royalty, ownership interest or future compensation will be payable to a member because their Member Content, question, answer, idea, suggestion or feedback contributed to the development of a myCAhub resource, product or service.
myCAhub may use Member Content without attribution.
Where reasonably possible, public-facing content derived from Community discussions will not include a member’s telephone number or directly identify the member unless:
- The member has provided consent;

- Disclosure is required or permitted by law.
Members retain ownership of their original Member Content, subject to the licence granted to myCAhub under these Terms.

Deleting a WhatsApp message or leaving the Community does not revoke any rights already granted to myCAhub.
Subject to applicable law, myCAhub is not required to delete anonymised, aggregated, incorporated or derivative materials that no longer directly identify the member.

9. Contributors, Administrators and Community Leads
myCAhub may appoint administrators, moderators, researchers, experts, community leads and other contributors.
The appointment of a contributor does not guarantee the accuracy, availability or completeness of their responses.
Unless expressly authorised in writing, no administrator, moderator, contributor or community lead may enter into an agreement or make a binding commitment on behalf of myCAhub.
Contributors may be subject to separate service provider, confidentiality, intellectual-property or copyright-assignment agreements.
Where a separate signed agreement applies to content created by a contributor, the intellectual-property provisions of that agreement will prevail over these general Terms to the extent of any conflict.
10. Privacy and WhatsApp Visibility
The Community operates through WhatsApp, which is a third-party platform operated independently of myCAhub.
Your use of WhatsApp remains subject to WhatsApp’s own terms, policies, security measures, functionality and privacy practices.

- Status or “about” information;
- Messages, reactions and Community activity; and
- Participation in particular groups or subgroups.
By joining the Community, you acknowledge that this information may be visible to other participants.
You must not join or remain in the Community if you are unwilling for the information displayed by WhatsApp to be visible in this manner.
myCAhub may process information available to it for purposes including:
- Administering membership;
- Communicating with members;

Further information regarding the processing of Personal Information is available in the myCAhub Clubhouse WhatsApp Community Privacy Policy.
11. Confidentiality and Member Safety

myCAhub is not responsible for another member’s unauthorised disclosure or misuse of information.
Suspected harassment, fraud, inappropriate private messaging or misuse of member information should be reported to a Community administrator or emailed to info@myCAhub.co.za.
12. Sponsored Content and Commercial Partnerships
myCAhub may enter into sponsorship, advertising, promotional, affiliate, referral, partnership or other commercial arrangements relating to the Community.

- Paid announcements;
- Advertisements;
- Branded content;
- Partner messages;
- Event promotions;
- Product or service promotions;
- Special offers or discounts;
- Affiliate or referral links;
- Competitions and giveaways; and
- Other approved commercial communications.
myCAhub may receive payment, commission, services, products, promotional benefits or other consideration in connection with sponsored content or commercial partnerships.
myCAhub retains sole discretion regarding:
- Whether to accept or reject a sponsor or commercial partner;
- The nature and format of sponsored content;
- The groups or subgroups in which sponsored content is published;
- The timing, frequency, placement and duration of sponsored content;
- The wording, branding and presentation of sponsored content; and
- Whether sponsored content is edited, removed, repeated or discontinued.
Where required by applicable law or considered appropriate by myCAhub, sponsored content may be identified using wording such as “Sponsored”, “Advertisement”, “Paid Partnership” or similar wording.
The publication of sponsored content does not necessarily mean that myCAhub independently verifies, guarantees, recommends or endorses the sponsor or its products, services, claims or offers, unless myCAhub expressly states otherwise.
Members remain responsible for conducting their own enquiries and due diligence before relying on, purchasing or engaging with any sponsored product, service, offer or opportunity.
Members are not entitled to receive any portion of sponsorship, advertising, referral, affiliate or other commercial revenue earned by myCAhub as a result of operating the Community.
The restrictions on unauthorised advertising and promotion by members do not limit myCAhub’s right to publish its own commercial communications or content from sponsors and commercial partners approved by myCAhub.
13. Third-Party Links, Services and Member Dealings
Members, sponsors, commercial partners or myCAhub may share links, recommendations, opportunities or information relating to third-party services.

- Act as an agent for members or third parties;
- Participate in private agreements between members; or
- Accept responsibility for services supplied by another member, sponsor, commercial partner or third party.
Any private engagement, employment discussion, referral, transaction or professional relationship entered into between members or with a third party is undertaken independently and at the members’ own risk.
Members must perform their own due diligence before sharing information, paying money, accepting employment, appointing a service provider, purchasing a product or relying on a recommendation.
14. Moderation and Enforcement
myCAhub may review and moderate Community content available to it as an administrator.
Where myCAhub believes that these Terms have been breached, myCAhub may:
- Issue a warning;

- Restrict posting privileges;
- Remove a member from one or more groups;
- Remove a member from the entire Community;
- Block a telephone number;
- Deny future membership;
- Preserve relevant messages, screenshots or records;
- Report conduct to WhatsApp;
- Report suspected unlawful activity to an employer, professional body, regulator or law-enforcement authority where reasonably necessary or legally required; and
- Pursue any available legal remedies.
myCAhub is not obligated to investigate every complaint or mediate disputes between members.
A failure to enforce a rule in one instance does not prevent myCAhub from enforcing it in another instance.
15. Removal and Leaving the Community
A member may leave the Community at any time by exiting the relevant WhatsApp groups.
myCAhub may remove a member at any time where permitted by law, including where:
- These Terms or group-specific rules are breached;
- The member causes disruption, hostility or repeated conflict;
- Another member’s safety or privacy is threatened;
- Unauthorised advertising or private solicitation occurs;
- Community content or member information is copied, scraped or extracted;
- Fraud, impersonation, dishonesty or misrepresentation is suspected;
- Continued participation creates legal, regulatory, operational, security or reputational risk; or
- Removal is otherwise considered reasonably necessary for the proper management of the Community.
Removal from the Community does not affect:
- Rights or licences already granted to myCAhub;
- myCAhub’s ownership of its Community materials;
- Any legal rights arising before removal; or
- Any provisions of these Terms intended to continue after membership ends.
16. Availability and Changes to the Community

myCAhub will not be liable for indirect, incidental, special or consequential loss, loss of profit, loss of opportunity, reputational harm or business interruption.
Nothing in these Terms excludes or limits any liability that may not lawfully be excluded or limited under applicable South African law.
18. Indemnity
To the maximum extent permitted by law, you agree to indemnify and hold harmless myCAhub, its directors, employees, contractors, administrators, community leads, contributors, agents and affiliates from claims, losses, liabilities, damages, penalties, costs and reasonable legal expenses arising from:

19. Governing Law and General Terms
These Terms are governed by the laws of the Republic of South Africa.
Any dispute arising from or relating to these Terms or the Community will be subject to the jurisdiction of the competent South African courts.
If any provision is found to be unlawful, invalid or unenforceable, that provision will be amended to the minimum extent necessary or severed without affecting the remaining provisions.
These Terms, together with the myCAhub Clubhouse WhatsApp Community Privacy Policy and any applicable group-specific rules, constitute the agreement between myCAhub and the member regarding participation in the Community.
A failure or delay by myCAhub to enforce a provision does not constitute a waiver of that provision.
Members may not transfer their rights under these Terms without myCAhub’s prior written permission.
myCAhub may transfer its rights and obligations to an affiliate, purchaser, successor or entity acquiring all or part of the Community or myCAhub business.
20. Changes to These Terms

- Another reasonable communication method.
The updated date displayed at the top of these Terms will indicate when the latest version took effect.
Your continued participation after updated Terms have been communicated constitutes acceptance of the updated Terms.
If you do not agree to an updated version, you must leave the Community.
