1. Acceptance

If you do not agree to these Terms, do not use the service.

The database is intended solely for informational and benchmarking purposes.

The database does not provide:

• Legal advice
• Tax advice
• Employment advice
• Recruitment advice
• Financial advice
• Career advice
• Professional advice of any kind

Users rely on the information entirely at their own risk.

• Is submitted by users
• May be incomplete
• May be inaccurate
• May contain errors
• May be outdated
• May not be representative of the broader market
• May not reflect current market conditions

Whilst each contributor’s submitted salary information is verified against supporting documentation, myCAhub does not verify every single data point provided by the contributor and makes no representation regarding accuracy, completeness, reliability, or suitability.

Paid Access

Users may purchase time-limited access to the CA(SA) Salary Database through PayFast.

The duration of access applicable to a purchase will be displayed on the relevant product page at the time of purchase.

Access begins once payment has been successfully processed and remains active for the purchased access period.

myCAhub reserves the right to amend access periods, pricing, features, and product offerings from time to time. Any changes will apply only to future purchases and will not affect access already granted to existing users.

Contributor Access

Users may complete a salary survey and provide supporting verification documents.

If approved, the user may receive access to the full database for a specified period of time. 

The duration of access applicable will be displayed on the site..

Approval is entirely at myCAhub’s discretion.

Verification may take up to five (5) business days.

No guarantee of approval is provided.

6. Payment Terms

Payments are processed through PayFast.

All prices are displayed in South African Rand (ZAR).

Access will only be granted after successful payment confirmation.

myCAhub reserves the right to refuse, suspend, or cancel access where fraud, chargebacks, abuse, or payment irregularities are suspected.

 7. Refund Policy

Because the CA(SA) Salary Database is a digital product that provides immediate access upon payment:

• All sales are final.
• Refunds are generally not available once access has been granted.
• Refunds will not be provided simply because a user changes their mind.
• Refunds will not be provided because a user expected different salary data.
• Refunds will not be provided because a user did not fully utilise the access period.
• Refunds will not be provided because the user disagrees with, dislikes, or questions the data contained in the database.

Exceptions

Refunds may be considered where:

• Required by applicable South African law;
• Duplicate payments were processed;
• A verified technical fault prevented access and could not be resolved within a reasonable period.

Any refund request will be assessed on a case-by-case basis.

Contributor Access

Users who obtain access through an approved salary survey submission are not entitled to any monetary refund because no purchase was made.

Access remains subject to compliance with the Terms and Conditions.

All Services remain the exclusive property of Hoopoe Solutions until such a time as payment of the sale price, including the purchase price, VAT and delivery costs have been paid in full.

8. Intellectual property

myCAhub owns all rights, title and interest in the Website, the CA(SA) Salary Database, its structure, design, functionality, reports, benchmarks, aggregated data, data presentation, analysis, insights, graphics, graphs, branding, software, content and related materials.

While salary information may be contributed by users, the compilation, organisation, verification, categorisation, analysis and presentation of the data within the CA(SA) Salary Database remain the intellectual property of myCAhub.

Access to the CA(SA) Salary Database grants the User a limited, non-exclusive, non-transferable licence to view the information for their own personal and non-commercial use during the applicable access period. No ownership rights are transferred to the User.

The following activities are strictly prohibited:

• Copying data
• Downloading data
• Exporting data
• Scraping data
• Screen scraping
• Data mining
• Automated extraction
• Recording database content
• Taking screenshots
• Screen recording
• Republishing data
• Sharing data
• Redistributing data
• Selling data
• Commercial exploitation
• Circumventing security controls
• Using bots or automated tools

myCAhub reserves the right to suspend or terminate access where it reasonably believes that database content is being copied, shared, scraped, redistributed or otherwise misused.

Any unauthorised use of the database or its contents may result in legal action to protect myCAhub’s intellectual property rights and recover any losses suffered.

Users who submit salary information grant myCAhub a perpetual, royalty-free right to use, verify, anonymise, aggregate, analyse and display submitted information within the CA(SA) Salary Database and related products and services.

Any feedback, suggestions, recommendations, ideas, improvements or feature requests provided by a User or Contributor relating to the Website, database or services shall automatically become the exclusive property of myCAhub without compensation, attribution or restriction, and the User or Contributor irrevocably assigns all intellectual property rights therein to myCAhub.

myCAhub may monitor:

• Login activity
• Device activity
• IP addresses
• User behaviour
• Access patterns

to detect abuse and unauthorised use.

We reserve the right to:

• Suspend accounts
• Terminate accounts
• Block devices
• Block IP addresses
• Deny future access
• Pursue civil claims
• Pursue criminal complaints
• Recover damages

Users acknowledge that unauthorised copying or extraction of database content may cause substantial commercial harm.

myCAhub reserves the right to claim all available damages, losses, legal costs, investigation costs, and other remedies available under South African law.

12.  Legal Remedies

Unauthorised copying, extraction, redistribution, publication or commercial use of database content constitutes a material breach of these Terms and may constitute copyright infringement, unlawful competition, unlawful interference with business, breach of confidence, unlawful use of proprietary information and other actionable conduct under South African law.

myCAhub reserves the right to pursue all available legal remedies, including:

• Interdicts and urgent court applications;
• Claims for damages;
• Claims for loss of profits;
• Claims for reputational harm;
• Recovery of investigation costs;
• Recovery of forensic costs;
• Recovery of attorney and own-client legal costs;
• Recovery of tracing costs;
• Recovery of expert witness costs;
• Criminal complaints where applicable.

Users agree that myCAhub may use account information, access logs, IP addresses, device information and other available records as evidence in the investigation and enforcement of any breach.

13. Salary Survey Submissions

Users submitting salary information:

• Warrant that information is accurate to the best of their knowledge.
• Authorise myCAhub to review supporting documentation.
• Authorise AI-assisted verification processes.
• Authorise manual verification processes.

Submission does not guarantee approval.

14. Limitation of Liability

To the maximum extent permitted by law:

myCAhub shall not be liable for:

• Direct losses
• Indirect losses
• Consequential losses
• Loss of profits
• Loss of employment opportunities
• Business decisions
• Career decisions
• Salary negotiations
• Errors in database information

The service is provided on an “as-is” and “as-available” basis.

15. Indemnity

You agree to indemnify and hold harmless myCAhub, its owners, employees, contractors, agents, and affiliates from any claims, losses, damages, costs, or expenses arising from:

• Your use of the service
• Your breach of these Terms
• Your misuse of database content
